Terms of Service
Last updated July 23, 2026. By using xeek, you agree to these terms.
1. The service
xeek is a peer-to-peer marketplace platform. We help users list items, express interest, message, track sales status, and leave feedback. We are not a party to sales between users, not an escrow, and do not process or guarantee payments, shipping, or item condition.
2. Accounts
- You must provide accurate information and keep your login secure.
- You are responsible for activity under your account.
- You must be old enough to form a binding contract in your jurisdiction (and at least 16 where required).
- We may suspend or ban accounts for abuse, fraud, or policy violations.
3. Listings & content
- You may only list items you have the right to sell or trade.
- Descriptions and photos must not be knowingly misleading.
- Prohibited: illegal goods, stolen property, weapons where restricted, scams, spam, hate, or content that violates our Community Guidelines.
- We may remove listings or content at our discretion.
- You grant us a non-exclusive license to host and display your listings and photos on the service.
4. Buying, selling & payments
- Expressing buy interest or joining a queue is a serious commitment; do not do so unless you intend to complete the purchase if selected.
- Payments are arranged directly between buyer and seller using methods they agree on (e.g. PayPal, Venmo, cash). xeek never takes custody of funds.
- Shipping, local pickup, returns, and warranties are between the parties unless you agree otherwise in writing.
- Use the in-site messaging and transaction tools where possible so there is a record of the deal.
- Confirm receipt only when you have received the item as agreed.
5. Disputes between users
If something goes wrong, contact the other party first. You may report abuse or contact us for moderation (e.g. scams, policy violations). We may help facilitate communication or remove accounts, but we are not obligated to mediate or reverse private payments. Chargebacks and payment-provider disputes are handled with your payment provider.
6. Fees
The platform may be free or introduce fees later. Any fees will be disclosed before you incur them. Third-party payment apps may charge their own fees.
7. Acceptable use
You agree not to:
- Harass, threaten, or defraud others
- Circumvent bans, scrape the site abusively, or attack our systems
- Misuse reports, feedback, or trust verification
- Use the service for money laundering or other illegal activity
8. Account deletion
You may delete your account from profile settings when you have no open transactions and no active buy queues on your listings. See our Privacy Policy for how data is handled after deletion.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that listings are accurate, that users will complete deals, or that the service will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, xeek and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goods, arising from use of the service or from user-to-user transactions. Our total liability for any claim relating to the service is limited to the greater of (a) fees you paid us in the 12 months before the claim, or (b) USD $50.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your listings, content, transactions with other users, or violation of these terms.
12. Changes & termination
We may change these terms or the service. Continued use after changes means you accept the updated terms. We may suspend or terminate access for any reason, including policy violations.
13. Governing law
These terms are governed by the laws applicable in the operator’s principal place of business, without regard to conflict-of-law rules, unless mandatory consumer protections in your country say otherwise.
